TERMS

  1. Stanmontage.com ā€“ StanMontage Sp. z o.o. Wersalska 47/75 lok. 312, 91-212 ÅĆ³dÅŗ, NIP: 9472008605.
  2. Service ā€“ the online platform operating under the domain stanmontage.com;
  3. Client ā€“ an individual with full legal capacity, and in cases provided for by generally applicable regulations, also an individual with limited legal capacity, a legal person, or an organizational unit without legal personality, which is granted legal capacity by law ā€“ who has concluded or intends to conclude a Contract with StanMontage Sp. z o.o. or uses or intends to use at least one Service or Electronic Service;
  4. Product ā€“ a movable item available on the Service that is the subject of a Sales Agreement between the Client and StanMontage Sp. z o.o.;
  5. Service ā€“ a paid functionality available on the Service, immaterial in nature, which is the subject of a Contract between the Client and StanMontage Sp. z o.o.;
  6. Contract ā€“ a contract for the provision of Services concluded or concluded between the Client and StanMontage Sp. z o.o. via the Service or another type of contract, specified individually in the Regulations;
  7. Electronic Service ā€“ a service provided electronically by StanMontage Sp. z o.o. to the Client via the Service;

DATA CONTROLLER
The data controller within the meaning of the Regulation of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: Regulation) is StanMontage Sp. z o.o.

PURPOSE AND SCOPE OF DATA COLLECTION

During the presence of the user or Client on the Service, in particular while using Electronic Services or purchasing a Product or service provided by StanMontage Sp. z o.o. on the Service, they may be asked to provide (disclose) their personal data. The scope of providing data to StanMontage Sp. z o.o. is divided into mandatory and optional data, each time specified in the appropriate form for entering such data, according to the needs of the specific Product, Service, or Electronic Service the user or Client intends to use. Providing data is always voluntary but sometimes necessary for the proper execution of the order or Electronic Service.

Data processing is carried out solely for the purpose for which they were provided to StanMontage Sp. z o.o. Data processing for marketing purposes is carried out only after obtaining separate consent from the user or Client of the Service. Data processing for the purpose of sending commercial information is carried out only after obtaining separate consent from the user or Client of the Service.

The purpose of the Privacy and Security Policy is to define the actions taken by StanMontage Sp. z o.o. in the area of personal data protection processed, including those collected via the Service, such as registration, order submission, data recording on servers, and any other related activities in connection with using the Service. All actions of StanMontage Sp. z o.o. are subject to the provisions of Polish law and the General Data Protection Regulation (Regulation). The Privacy and Security Policy is subject to the provisions of Polish law and the General Data Protection Regulation.

DURATION OF PERSONAL DATA PROCESSING

The data of the Client of the Service will be processed for the duration of the contract for the provision of Electronic Services and up to 30 days from the termination of the contract for the provision of Electronic Services, and in the case of a concluded Contract, for the duration of its performance and up to 10 years from its execution or from the withdrawal from the Contract.

VOLUNTARINESS OF DATA PROVISION

Each user or Client of the Service, in order to use the Electronic Services or place an order, has the right to voluntarily provide their data. When using certain services, including during the order process, entering data, although voluntary, may be necessary to perform the Electronic Service or fulfill the order.

The necessary (mandatory) data for entry when using the Electronic Service or fulfilling the order are always specified in the form designed for entering such data.

RIGHT OF ACCESS TO DATA

Each user or Client of the Service has the right to access and correct their data, in particular through access to the Client Panel or by contacting StanMontage Sp. z o.o.

In case of contact with StanMontage Sp. z o.o., for security reasons, your identity will be verified.

RIGHT TO DATA DELETION

Respecting the right of users and Clients of StanMontage Sp. z o.o., we inform you that every person has the right to delete their data. This right is commonly referred to as the „right to be forgotten”. StanMontage Sp. z o.o. is obliged to delete all data of the reporting person, provided there is no other legal basis for further processing of such data, such as the obligation to retain financial documentation. If the request cannot be fulfilled, we will inform you of this, stating the legal basis.

RIGHT TO DATA PORTABILITY

At the express request of the person whose data is processed by StanMontage Sp. z o.o., you will receive from us a file with structured data in a commonly used format. Within this right, you can also indicate the entity to which we, as the data controller, should transfer your data.

The execution of this right may take up to 30 days. At the same time, for security reasons, we will verify your identity to ensure that your data is transferred to the correct person.

SECURITY AND PROTECTION OF PERSONAL DATA

StanMontage Sp. z o.o. declares that it processes the personal data of users and Clients of the Service in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, and that it applies technical and organizational measures ensuring the protection of processed data appropriate to the risks and categories of data protected, in particular, it secures the personal data of users and Clients of the Service against unauthorized access, loss, or damage.

COOKIES

By „cookies” we mean IT data, in particular short text files, stored by the Internet browser or directly on the end devices of users intended for the use of websites. These files allow recognizing the user’s device and appropriately displaying the website tailored to their individual preferences. „Cookies” usually contain the name of the website from which they originate, the time of storage on the end device, and a unique number.

„Cookies” are used for the following purposes:

  1. creating statistics that help understand how users use the Service, which directly influences the improvement of their structure and content;
  2. maintaining the session of the user of the Service, thanks to which they do not have to re-enter their login and password or perform additional actions on each subpage of the Service, such as adding a product to the cart again;
  3. determining the user’s profile to display tailored materials in advertising networks, especially the Google network.

Within the Service, two main types of „cookies” are used: „session cookies” and „persistent cookies”. „Session cookies” are temporary files stored on the user’s end device until logging out, leaving the Service, or turning off the software (Internet browser). „Persistent cookies” are stored on the user’s end device for the time specified in the cookie parameters or until manually deleted by the user.
  2. The Internet browser software usually allows storing „cookies” on the user’s end device by default. Service users can change the settings in this regard. The Internet browser allows deleting „cookies”. It is also possible to block „cookies” automatically. Detailed information on this can be found in the help or documentation of the Internet browser.
  3. Restrictions on the use of „cookies” may affect some functionalities available on the Service.

BLOCKING OR DELETING COOKIES
According to the applicable provisions of the Act of 16 July 2004 Telecommunications Law (Dz.U. 2004 No. 171, item 1800, as amended), in particular Article 173 paragraph 2, the user has the right to decide on the access of „cookies” to their end device by setting the appropriate settings (rights) for these files in the settings window of their Internet browser.

Leaving the default settings of the software installed on the end device unchanged means agreeing to the placement of „cookies” on the user’s device.

SERVER LOGS

  1. Information about certain activities of users is subject to logging at the server layer. These data are used solely for administering the Service.
  2. The resources viewed are identified by URL addresses. Additionally, the following can be logged:
    1. time of request arrival;
    2. time of sending the response;
    3. name of the user station ā€“ identification through the HTTP protocol;
    4. information about errors that occurred during the HTTP transaction;
    5. URL address of the page previously visited by the user (referer link) ā€“ if the transition to the Service was made via a link;
    6. information about the user’s browser;
    7. information about the user’s IP address;
  3. These data are not associated with specific individuals browsing the pages.
  4. These data are used solely for administering the Service.

DISCLAIMER OF LIABILITY
The Privacy and Security Policy does not cover information regarding services, goods, or websites of third parties, made available in the Service under agreements with other entities. Third parties independently and on their own responsibility define separate, individual terms of operation of their services, goods, or websites in their regulations.

TRANSFER OF DATA OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)

StanMontage Sp. z o.o. transfers personal data to third countries outside the European Economic Area solely for the purpose for which they were provided, to: Google LLC based in Mountain View, USA, under the so-called EU-US Privacy Shield (hereinafter: Agreement), i.e., in accordance with the European Commission’s decision of 12 July 2016 number IP/16/216, the transfer of personal data to entities based in the USA that have joined the Agreement ensures an adequate level of personal data protection, in accordance with Article 45 of the Regulation.
